# Budgy - Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of the Budgy iOS app ("App"), provided by Thomas Mauriello, an individual developer based in Italy ("we", "us", "our", "controller" or "provider").

By downloading, accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.

## 2. Relationship with Apple and the App Store

The App is distributed through the Apple App Store. Your use of the App is also subject to Apple's applicable rules, including the App Store terms, usage rules for digital content and, where applicable, Apple's Standard End User License Agreement or another applicable license.

Apple is not a party to these Terms between you and the App provider, except as provided by Apple's terms. In-app purchases, subscriptions, refunds, billing and payment method management are handled by Apple through the App Store and StoreKit.

## 3. Eligibility

You may use the App only if you have the legal capacity to accept these Terms and if your use is permitted by applicable law.

If you use the App on behalf of an organization, you represent that you have authority to accept these Terms for that organization.

The App may also be used by minors only in compliance with App Store rules, parental controls and applicable laws. If you are a minor, you must use the App with the consent or supervision of a parent or guardian where required by law.

## 4. License to use the App

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the App on Apple devices that you own or control, in accordance with these Terms and Apple's applicable rules.

You may not:

- copy, modify, distribute, sell, sublicense or create derivative works of the App, except where permitted by law;
- decompile, disassemble, reverse engineer or attempt to derive the source code of the App, except to the extent permitted by law;
- use the App for unlawful, fraudulent, abusive purposes or in a way that infringes third-party rights;
- circumvent technical limits, premium features, payment systems or protection mechanisms of the App;
- interfere with the operation of the App, Apple services, Firebase or other technical services connected to the App.

## 5. What Budgy does

Budgy is an app for personal finance management. The data you enter is created and kept on your device; if you connect an account you can also sync it and share an account with another person, as explained in sections 8, 9 and 10. The App can help you:

- create and manage accounts or wallets;
- record income, expenses, categories, notes, payment methods and recurring transactions;
- set category budgets;
- view statistics, summaries and spending maps;
- import and export data in CSV or XLSX format;
- attach photos or receipts to transactions;
- use OCR on receipts through Apple on-device technologies;
- save savings goals;
- manage debts, credits, gift cards and loyalty cards;
- schedule local reminders;
- use an iOS widget connected to App data;
- connect an account to sync your data across your devices;
- share an account with another person, seeing and writing the same transactions;
- save a password-protected backup file and restore it.

The features actually available may change over time and may depend on the free plan, an active PLUS subscription, the device, the iOS version, the permissions granted and the availability of Apple or Firebase services.

## 6. No financial advice

Budgy is a personal organization tool. The App does not provide financial, tax, legal, accounting, investment or other professional advice.

The information, summaries, statistics, categories, maps and amounts shown by the App are based on the data you enter or import. You must verify their accuracy, completeness and relevance before making economic or personal decisions.

We are not responsible for decisions made based on data, summaries or analysis generated by the App.

## 7. User data and responsibility

You are responsible for the data you enter, import, save or share through the App, including amounts, notes, descriptions, wallet names, custom categories, receipts, attachments, locations, barcodes, gift cards, loyalty cards, goals, debts, credits and reminders.

You must ensure that you have the right to store and use such data and that you do not violate laws or third-party rights.

You are responsible for device security, backups, physical access to the device and your iCloud or other Apple service settings.

If you use a shared account, you are also responsible for what you write in an account another person reads, and for that person's data that reaches your device: you may use it to manage your shared expenses, not for other purposes.

## 8. Where your data lives

The App stores data in its local store and, for some features, in local files or local preferences. Attachments are saved as files managed by the App. Without a connected account, your data stays on this device.

If you enable or keep device iCloud Backup active for the App's data, the local store and attachments may be included in iCloud backups managed by Apple. If you disable iCloud Backup for the App through the available settings, the App attempts to exclude those files from device backup.

If you connect an account, the App can copy your data to our servers, hosted on Firebase in the European Union. Syncing has two independent switches, "personal data" and "shared accounts", which you will find in the account screen and can turn off at any time. Syncing does not require a subscription.

When you turn off syncing of personal data, the App offers to delete the copy already held on our servers, attachments included. It does not offer this for shared accounts, and that is deliberate: those transactions also belong to the other person, and removing them would empty their accounts. See section 10.

When you delete something that had been synced, a marker of that deletion remains on the server for a period, so that your other devices can apply it even if they were switched off. That marker is removed automatically after ninety days.

We cannot guarantee successful backup, restore, device migration, syncing or data recovery, because those processes also depend on iOS, iCloud, Apple, Firebase, the network, available storage, device settings and local file status.

The App may offer tools to delete local data. Local deletion may not remove copies already present in iCloud backups, exported files, third-party services, shared accounts or devices where you have shared the data.

## 9. Your account

The account is optional: without one, the App works on this device alone. It is needed for syncing and for shared accounts.

You sign in with Sign in with Apple or with Google. We do not create passwords and we do not store any. We receive from Apple or Google an account identifier and, if you choose to share them, your name and email address.

You are responsible for access to your Apple or Google account: whoever gets in there can get into your Budgy data.

You can delete your account from within the App. Deletion removes the copy of your personal data from our servers, attachments included, removes you from other people's shared accounts and unlinks your subscription. Two things remain, and you should know them beforehand: **the transactions you wrote in another person's shared account stay with them**, because those are also their accounts; and if you are the one who created shared accounts, you must first delete or transfer them, otherwise account deletion is refused. Deleting your account does not cancel and does not refund a subscription: that is managed by Apple.

## 10. Shared accounts

A shared account lets two people see and write the same transactions. Creating one requires an active PLUS subscription; the person you invite does not need it and, once inside, can do the same things. A shared account has at most two participants.

Only the person who created the account can invite, with a code that works for one person, is disabled as soon as it is used and expires after seven days.

**What the other person sees.** For every transaction in that account: amount, date, category, payment method, notes, recurrence, any attached receipts, and — if you chose to add it — the location. They also see who wrote each transaction, with your account name, and the reactions people leave on transactions.

**What does not enter the shared account.** Your other accounts, budgets, goals, debts and credits, cards, and the tags you put on transactions: tags stay yours even when you apply them to a shared transaction.

**If you leave.** The transactions you entered stay in the account and with the other person: they are your shared history, and removing them would empty their accounts. On your phone the account stops updating and you can take a copy of the transactions you had already downloaded. Whoever created the account cannot leave: they can transfer it to the other person or delete it.

**If the account is deleted** by whoever created it, it stays readable for thirty days before being permanently removed from our servers, and during that window the deletion can be undone.

**If the subscription of whoever created the account ends**, the account is not deleted and stays readable and exportable: after a tolerance period it stops accepting new writes from both people until the subscription resumes. In case of a refund this may happen immediately.

## 11. Imports, exports and sharing

The App may import CSV files selected by the user and may export data in CSV or XLSX format. Import is processed by the App on the device; you must verify that imported data is correct.

When you export or share files, you choose the destination service or app, such as email, cloud storage, messaging or other apps. After sharing, those data are subject to the terms and privacy policies of the service you choose.

We are not responsible for loss, disclosure, modification, failed delivery or misuse of data after you export, share or transfer them outside the App.

## 12. Camera, photos, OCR, barcodes and location

Some features require device permissions or services:

- the camera may be used to photograph receipts or scan barcodes from gift cards and loyalty cards;
- the photo library may be used to select attachments;
- Apple Vision and CoreImage may be used on-device to recognize text from receipts;
- location may be used, if authorized, to associate a transaction with a place;
- MapKit, geocoding and place search may be used to display maps, resolve addresses or find places;
- local notifications may be used for reminders and recurring transactions.

You can grant, deny or revoke these permissions through iOS. If you do not grant some permissions, the related features may be unavailable or may work only partially.

Receipt OCR and barcode scanning may produce incomplete or incorrect results. You must verify amounts, dates, notes, addresses, payment methods, categories, currencies and any other automatically filled data before saving a transaction or card.

## 13. Free plan and PLUS

Budgy may offer a free plan and one or more paid plans identified in the App as PLUS, Budget+ or similar names.

The free plan may include limits on some features, such as the number of budgets, recurring series, savings goals, custom categories, free receipt scans, payment methods, additional wallets, export or access to advanced sections. The actual limits are those shown in the App at the time of use and may change over time, in compliance with applicable law and any rights already accrued.

PLUS may unlock additional features, including multiple wallets, advanced budgets, custom categories, payment methods, attachments, receipt scans, detailed statistics, recurring transactions, savings goals, debts and credits, gift cards, spending maps, export and advanced widget configuration.

If a subscription expires, is cancelled or cannot be verified, the App may limit creation or use of new premium features. Within technical limits and unless required for security or legal reasons, the App aims not to block access to and editing of data already created.

## 14. Subscriptions, free trials and payments

Subscriptions are purchased through the Apple App Store. The price, duration, any free trial, applicable taxes and renewal terms are shown in the App and/or by Apple before you confirm the purchase.

Available subscriptions may include, for example, a monthly plan and a yearly plan. Technical product identifiers may be used by the App to verify subscription status.

If a free trial is available, eligibility depends on Apple's rules, the subscription group and the user's history. The App tries to show the free trial only when it appears to be available, but final confirmation is handled by Apple.

Auto-renewable subscriptions renew automatically unless cancelled according to Apple's rules. You can manage or cancel your subscription from your Apple account or App Store settings. Cancellation stops future renewal but does not necessarily refund the period already paid for.

Refunds are handled by Apple according to its own rules. We do not collect or store your complete payment method details.

## 15. Availability, updates and changes to the App

We may modify, update, suspend or discontinue App features, including to fix errors, improve security and stability, comply with legal or Apple requirements, change the product model or introduce new features.

We will try to avoid unjustified changes that compromise data already saved, but we do not guarantee that every feature will remain available indefinitely.

Some features may depend on third-party services or frameworks, including Apple, Firebase/Google and the iOS operating system. We are not responsible for interruptions, changes, errors or limitations caused by those services.

## 16. Privacy and telemetry

Data processing is described in the App's Privacy Policy. The Privacy Policy explains which data are processed locally, which data may be shared with Apple, Google/Firebase or other providers, and which choices you have regarding analytics, diagnostics, notifications, location and backup.

Some technical and diagnostic information may be collected only if you have given the relevant consent in the App, as described in the Privacy Policy.

## 17. Legal documents and updates to these Terms

The App displays its Terms and Privacy Policy by loading them from the configured remote service. Each time you open either document, the App requests the version available from the service at that time and does not use local copies or locally cached versions. A network connection is therefore required to view the documents; if loading fails, you can retry from the App.

We may update these Terms when the App, features, services used, legal rules or business model change. The last updated date indicates the applicable version.

If a change is material, we may notify you in the App or by other reasonable means. By continuing to use the App after the new Terms become effective, you accept the updated version, unless the law requires express consent.

## 18. Intellectual property

The App, design, code, interfaces, graphics, texts, trademarks, names, icons and other App materials are owned by the provider or their respective owners, unless otherwise indicated.

These Terms do not transfer any ownership rights in the App or its content to you. You retain rights in the data you enter into the App, subject to third-party rights and applicable law.

## 19. Third-party services

The App may interact with third-party services, systems or frameworks, including:

- Apple App Store, StoreKit, iCloud, iOS, MapKit, CoreLocation, Vision, local notifications and widgets;
- Google/Firebase for analytics, diagnostics, crash reporting and distribution of legal documents, where enabled or necessary;
- apps or services chosen by you to export, share, open or store files.

Use of such services may be subject to the terms and privacy policies of the respective providers. We do not control those services and are not responsible for their operation, content, security or data processing, except as required by applicable law.

## 20. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available". We do not guarantee that the App will always be available, error-free, secure, compatible with every device, suitable for every need, or that the data shown will always be correct, complete or up to date.

Nothing in these Terms limits mandatory consumer rights recognized by applicable law.

## 21. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special or consequential damages, loss of profit, loss of data, loss of opportunity, business interruption or economic decisions made based on the App.

Our total liability for claims relating to the App will not exceed, to the extent permitted by law, the amount paid by the user for the App or subscription in the 12 months preceding the event giving rise to the claim, or 10 euros, whichever is greater.

These limitations do not apply where the law does not allow them to be limited, including intentional misconduct, gross negligence, personal injury or mandatory consumer rights.

## 22. Indemnity

To the extent permitted by law, you agree to indemnify and hold the provider harmless from claims, damages, liabilities, costs and expenses arising from:

- unlawful or abusive use of the App;
- violation of these Terms;
- violation of applicable laws or third-party rights;
- data, content or files that you enter, import, export or share through the App.

This clause applies only to the extent permitted by law and does not limit mandatory consumer rights.

## 23. Withdrawal, suspension and termination

You may stop using the App at any time. You may delete the App from your device and, where available, use internal tools to delete local data.

We may suspend or terminate access to certain features if you materially breach these Terms, if the App is withdrawn, if necessary for security or legal reasons, or if essential services are no longer available.

Termination does not affect obligations already accrued, subscriptions managed by Apple or clauses that by their nature must continue to apply.

## 24. Governing law and jurisdiction

These Terms are governed by Italian law.

If you are a consumer resident in the European Union or another country with mandatory consumer protection rules, the mandatory rights and protections provided by the law of your country of residence remain unaffected.

Any disputes will be handled according to the jurisdiction rules provided by applicable law.
